Booking Conditions
Important – please read prior to making your reservation
1. How to Book
Book as early as possible by sending a non-refundable deposit $ 500 ( Five hundred dollars New Zealand) per person payable to African Crusaders Limited. Your confirmation will be sent to you immediately. The balance of the fare is due 8 weeks prior to departure.
No contract shall exist until the prescribed deposit has been paid. The deposit will be refunded should we not be able to accommodate you on the requested tour.
2. Amendments
Should you wish to alter your arrangements after your original booking, you should notify us in writing and we will try to accommodate you. However, due to extra administrative costs involved, we may be obliged to pass costs on to you for such amendment. Amendments before departure are subject to cancellation fees as below.
3. Cancellations and Refunds – Land Arrangements
If it is necessary to cancel your holiday, all moneys will be refunded less a cancellation fee per person per arrangement as follows:
• More than 8 weeks before departure – deposit
• Less than 8 weeks before departure – maximum of 60% of the tour fare
• Less than 4 weeks before departure – maximum of 80 % of the tour fare
• Less than 14 days before departure – maximum of full tour fare
We may charge you a cancellation fee as long as and to the extent that we have carried out our service with reasonable care and skill and to your reasonable requirements. This cancellation fee is required to offset booking communication and administration charges which will already have been incurred by us. In addition to our cancellation fee, you may also be required to pay cancellation fees imposed by our suppliers. The amount of each supplier’s cancellation fee is beyond our control and payment is solely your responsibility. Please check with your travel agent concerning the amount of a supplier’s cancellation fee.
If you fail to join a tour, or join it after departure, or leave it prior to its completion, no tour fare refund will be made unless by prior agreement that only a portion of the tour is to be undertaken.
4. Cancellations and Refunds – Air Arrangements
Cancellation fees will apply as required by airline tariff regulations and will vary dependent upon the type of air fare utilised.
5. Non-Use of Services or Facilities
If, of your own choice, you decide not to use part or parts of the arranged services or facilities, you will not be entitled to a refund from us (provided we have carried out our service with reasonable skill and care and to your reasonable requirements). You may not be entitled to a refund from any supplier (unless otherwise specified).
6. Not Included in Tour Cost
• Return air fares to South Africa
• Alcoholic beverages
• Personal and travel insurance
• Souvenirs and items of a personal nature.
• Gratuities
7. Hotel Descriptions, Maps and Photographs
Descriptions featured in the information provided are based on current hotel guides and contractual agreements provided by suppliers. Any facilities described are subject to change at any time. Maps and photographs are included for general information and may not necessarily reflect actual routings, locations or services. Hotel room photographs may not be specific to the actual room occupied.
8. Insurance
You agree that we will have no liability for loss or damage of any kind (direct, indirect, consequential or otherwise) you may suffer resulting from cancellation, loss of luggage and personal property, medical expenses and the effects of accident, however it is caused. It is your responsibility to insure yourself fully. This means that travel and cancellation insurance is mandatory. Before you commence a tour, you must arrange your own insurance with a reputable insurer, with protection for the full duration of the tour, to cover personal injury, medical expenses, repatriation expenses, loss of luggage and the expenses associated with cancellation or curtailment of a tour. If you become ill, all hospital expenses, doctors fees and repatriation costs are your responsibility and we shall not be liable for any refund of the tour cost. Your travel agent will be able to provide you with further information.
9. International Travel Documents
It is your responsibility to be in possession of a valid passport, visa permits, vaccination an other medical certificates and all other travel documents, including travelers cheques where applicable. Details of vaccination certificates and visa requirements are available from your travel agent.
10. Responsibility
The guarantees under the Consumer Guarantees Act 1993 will apply to services supplied by us, except where they are acquired, or held out as being acquired, for business purposes.
The services that African Crusaders Limited supply consist of arranging and co-ordinating travel.
Subject to the client filling in details of services, we will not be liable for any loss or damage of any kind (direct, indirect, consequential or otherwise) which you may suffer resulting from our selection of those suppliers, or your use of consumption of, or inability to use or consume those facilities or services.
We undertake to perform these services with reasonable care and skill. We will not be liable for any loss or damage which results from the act, default or omission of any person other than ourselves, our employees or agents or any cause independent of human control. This includes (but is not limited to) loss or damage which arises, directly or indirectly, from any act of God, weather disruptions, dangers incidental to sea, fire, breakdown in machinery or equipment, acts of Government or other authorities de jour or de facto, wars, whether declared or not, acts of terrorism, hostilities, civil disturbances, strikes, riots, pilferage, quarantines or medical or customs regulations.
We are not able to exercise control over services we do not supply directly, therefore we will not be responsible for any loss or damage arising from:
• any booking made directly with a service supplier by your travel agent; or
• any services that are not provided by us and which are additional to those described in the information provided to you.
We will endeavour to provide the most suitable travel arrangements to meet the particular requirements you have made known to us. However, travel is an individual experience and your preferences and opinions may vary from our own. For this reason, we cannot take responsibility for your individual satisfaction.
Supply of travel, entertainment, accommodation services and facilities:
When we make your bookings with our suppliers of travel, entertainment and accommodation facilities or services, we are acting as a booking agent for the suppliers.
All travel, entertainment and accommodation facilities or services are supplied directly to you by the supplier. We have no control over the facilities or services themselves, or the manner in which they are provided by the supplier. Therefore you should be aware of the following conditions:
(i) We will not be liable for any loss or damage of any kind which may arise from your use or consumption of, or any inability to use or consume those facilities or services:
(ii) The provision of those facilities and services is subject to those terms and conditions of contract with each supplier;
(iii) Where for any reason a supplier is unable to provide particular facilities or services, then that supplier may be entitled, under its contract with you, to substitute those services or facilities with comparable services without incurring any liability to you. You should check your contract with each supplier.
(iv) All facilities or services described by us are subject to availability from the supplier.
(v) We will not be liable or responsible for any loss or damage relating to your baggage, personal possessions, health or welfare, or delays or travel disruptions, unless these arise directly from the service we provide to you.
11. Business Purposes
You agree that where our services are required for business purposes, or where you hold yourself out as acquiring our services for business purposes, the Consumers Guarantees Act 1993 will not apply to any supply of goods or services made under these Conditions and we will not be liable or responsible for any loss or damage of any kind to you, including any consequential loss or damage however it may be caused.
12. Alterations to Itineraries
Although every effort is made to adhere to itineraries printed in the information provided to you, we reserve the right to occasionally change routes and accommodation as brought about by changing conditions. We reserve the right to alter itineraries after departure if it is in your interests to do so.
13. Authority on Tour/Exclusion from Tour
The decision of the driver/guide will be final on all matters likely to endanger the safety of the group. We shall not be responsible for or liable to anyone who commits an illegal or unlawful act in any country visited. You may be excluded from the tour without any refund of the tour fare. If we consider you unsuitable for a tour, we may, in our absolute discretion, cancel your booking or decline to carry you further if you cause inconvenience or annoyance to other passengers.
14. Health
You acknowledge being aware of the proposed itinerary and hereby confirm that you are medically fit, in good health and able to embark upon the tour. If you have a pre-existing medical condition or illness, you must declare the true nature of this condition at the time of booking and make arrangements for the provision of any drugs or otherwise for the purposes of treatment that may be required during the tour. You would be required in such a case to provide a medical statement from a GP to confirm that you are fit to travel. We will treat all information in the strictest confidence. Medical insurance is compulsory. Should you not hold this insurance it will be necessary to purchase it prior to departure.
15. Information in Brochures
While we have exercised reasonable care and skill to ensure the contents of the information provided to you are correct, accurate and up to date at the time of printing, please note that the contents of this brochure are based on information supplied to us by the suppliers. We do not have and cannot be reasonably expected to have personal knowledge about all of the facilities or services provided by each supplier.
Facilities and services may change after the date of printing. We endeavour to keep travel agents informed of any changes to information in this brochure which are brought to our attention. Prior to booking, you should ask your travel agent about any changes to the published information of which your agent may be aware. You should also make sure that, if your travel agent is advised of changes that occur after booking, your travel agent is able to contact you.
All maps, illustrations and photographs are for indicative purposes only and may not necessarily reflect actual places or positioning.
16. Prices
16.1 Unless otherwise specified, all prices in this brochure are on a per person / twin share basis and are expressed in New Zealand dollars.
16.2 Events beyond our control, such as currency fluctuations, changes to the price or aviation fuel or changes to the costs of services and facilities may result in the prices charged to you being different to those shown in the brochure. You should check all prices with your travel agent before making reservations and before making final payment.
16.3 Prices may also be liable to variation between the time of booking and departure. We reserve the right to vary the price up until the time of final payment being received by us.
16.4 Receipt of a deposit will be taken as an understanding by us that the participant has read and agrees to abide by these Terms and Conditions.
17. Legal Claims
Any claims or legal action in connection with the provision of our services to you will be governed by the laws of New Zealand. Any claim or legal action against the suppliers is likely to be subject to the terms of your contract with them, and may be governed by the laws of other countries.
